WHAT IS THE GDPR?

The General Data Protection Regulation (GDPR) aims to strengthen data protection for people within the European Union, replacing the EU privacy directive known as Directive 95/46/EC. This regulation is overseen by the European Parliament, the Council of the European Union and the European Commission. It will become enforceable on 25 May 2018. WHAT DOES THE GDPR MEAN FOR YOU?

The GDPR improves data security – it means that you have better control of the data we hold about you.

  • Consent: We will not send you any emails without your explicit consent, which we obtain by you filling in your details using our newsletter subscription form.

HOW DO WE COLLECT DATA?

We collect information about you when you subscribe to our newsletter, you email us (through the contact form on our website) and when you visit our website. As you navigate through our website certain technical information is gathered without you actually providing this to us using various technology and means. This information includes internet protocol addresses, internet tags, navigational data (“log files”, “server logs”, and “clickstream” data), the internet platform you are using and device identifiers in order record the information about your visit and to provide you with a better web experience.

HOW DO WE USE YOUR DATA?

We use your information (name and email address) with your explicit consent to deliver our newsletter. We will not use your email address for any other purpose without your permission, and we will never sell or exchange your personal information with other organisations for marketing purposes. You can change your newsletter subscription settings and unsubscribe anytime by clicking on the link at the end of our email newsletter.

HOW DO WE STORE YOUR DATA?

We use MailChimp, a US-based email service, to store your details and send you our newsletter. In the process of working with Mailchimp your data may be transferred outside the EEA, to the US. Mailchimp is self-certified under Privacy Shield and lawfully transfers EU/EEA personal data to the US according to its Privacy Shield Certification. HOW DO WE ENSURE OUR PRIVACY POLICY IS UP TO DATE?

The webpage offtoursbudapest.com is operated by Offtours Kft. We pay particular attention to comply with the data protection regulations in force during the handling of data. Please read this Information carefully so that you will know how we manage your personal data and what rights you have in this respect.

The scope of data handling

When viewing the website, due to technical operation, the start and end time of the user’s visit is automatically recorded, and in some cases – according to the settings of the user’s computer – also the browser, the operating system information, the user’s IP address and the name of the page from which the user arrived. From this data, the system automatically generates statistical data. The operator does not link these data with other personal data, they are used for statistics exclusively. The webpage sends cookies to the visitor’s computer.

Email addresses and names provided with voluntary consent are handled on the webpage, and in connection to this, also the types of tours the given user has previously participated in.

The purpose of data handling

Recording and storing data regarding the date of the visit, the IP address, the browser and the operating system is a feature of the system operation, the handling thereof is technically inevitable, and is carried out exclusively for statistical purposes.

In case of a request for quote/inquiry on tour participation, the provision of an email address as personal data is required through the email message sent to the provided email address, furthermore we can request additional non-personal data (number of participants, planned dates, other questions and needs). 

In case of using the newsletter service, the provision of a name and email address is required also.

It is possible to write comments on our website, for which the provision of a name and email address is required. The email address of the commenters does not appear, only the name provided by them.

By providing their information, the users give their consent for our company to handle their personal data. The handling of the data provided for using the webpage occurs with the users’ voluntary consent, in the knowledge of this information.

The duration of data handling

Session IDs are all deleted when the browser is closed. Users can delete their own cookies at any time.

Data of those who request a quote will be immediately deleted in case there is no contract that enters into force based on the quotation. Data of the service users will be stored until the end of the general limitation period, i.e. for 5 years. Comments will be stored until the interested party request their deletion.

Availability and processing of data

The company executive and co-workers especially authorised by management have the right to access personal data provided by the users, and also data automatically stored due to technical functioning (except for the name of commenters). Data Controller does not publish the data (with exception to the name provided by commenters) and transfers them to third parties exclusively in case of an applicable legal ground.

Data Controller may commission a data processor (e.g. system operator, accountant) for the operation of the IT system, the completion of orders and the managing of accounts. Data Controller is not responsible for the data handling practice of such third parties. Third party data processers are the following: the firm responsible for Data Controller’s accounting (Next Generation Consulting Kft.), the operator of the Billingo invoicing system used by Data Controller (Billingo Technologies Zrt.), Data Controller’s IT developer (Plexipi Kft.), the operator of Data Controller’s newsletter service system (SalesAutoPilot Kft.), the bank where Data Controller’s account is held (Magnet Bank), Data Controller’s hosting provider (ATW Internet Kft.).

User rights

An interested party can request the following from Data Controller:

a) information on the handling of personal data,

b) correction of personal data,

c) deletion of personal data – except for those required for obligatory data handling.

At the request of the interested party, Data Controller provides information on the data handled by it, or processed by it or by a data processor commissioned by it, the source thereof, the purpose of the data handling, its legal ground, duration, the name of data processer, its address and its activity connected to the data handling; the circumstances of a data protection incident, its effects and the measures taken to tackle it, furthermore – in case of the transmission of the interested party’s data – the legal grounds and the recipient of the data transfer.

Data safety

We strive to carry out the safe handling of data, therefore we take all the technical and management measures that are necessary for the compliance with data protection rules.

For this reason, we use only legal software, we update these regularly and we work with competent IT professionals.

By browsing and using the offtoursbudapest.com webpage you declare that you have read and accepted the contractual terms for the use of the service, as well as the information on data handling, and you accept all clauses thereof.

The below contract enters into force with the finalisation of a tour registration, that is, when the participation fee is paid, between Offtours Kft. as the operator of the webpage  (Seller) and the visitor who is registering for the tour (Buyer).

With the reservation, Buyer declares that it is above the age of 18, that it is fully aware of and accepts the limitations of online shopping, and has read and accepted the GTC.

Description of the service

The website allows visitors to register for cultural city sightseeing tours. The programmes are held in Dunaújváros, Martonvásár and Vál, at the dates indicated on the webpage. Visitors can participate in the programmes following a preliminary online registration.

The programmes are held only if the minimum number of participants (12 pers.) is met, there are no further circumstantial conditions. The case of service provision failure is discussed under Additional provisions.

The indicated prices are gross amounts.

Registration

Registration occurs through the webpage, under the “DAILY” menu item. Following registration and the payment of the registration fee, Buyer receives a confirmation email  to the provided email address and an invoice with the provided data. This email contains the data provided during registration, the programme date and the most important information. Your registration becomes final with the confirmation email.

Registration process on the webpage:

Click on the DAILY menu item and choose the programme that you prefer. When clicking the RESERVATION button, above will appear the most important information regarding the tours, segments of the GTC and below the dates/tours.

Choose the preferred date from the appearing dates.

Enter the number of participants for the tour, for how many persons you would like to pay the tour. Here you can choose a maximum number that is still available for the tour. 

In the additional fields of the form please enter your personal and invoice data, and click on the Send registration button to confirm your registration, then through the Barion system, you will be able to carry out the payment by credit card. Online credit card payments are done through the Barion system. The credit card data are not transferred to the merchant. The service provider Barion Payment Zrt. is an institution controlled by the Hungarian National Bank, its licence  number is H-EN-I-1064/2013.

In case the confirmation email and the invoice are not sent within 24 hours after payment to the email address that you have provided, please contact us at hello@offtoursbudapest.com.

Participation fee, payment conditions

The programmes are of different prices, which can be found in each case in the description of the specific programme, and when clicking on the RESERVATION button. The indicated prices are gross amounts.

Sztálinváros/Dunaújváros:  15,000 HUF / person

Martonvásár+Vál: 12,000 HUF / person

Coupon codes and other previously bought tickets (tickets bought from resellers etc.) can be used to participate in a specific programme without the further payment of fees.

Payment can be done only by credit card through our online surface.

Coupon codes

Buyer has the right to withdraw from participation in the programme no later than 72 hours prior to the start of the programme, which can be done via the CANCEL tour link found in the confirmation email. In case of cancellation, we will send a coupon code, so the paid participation fee can be redeemed once for the same city tour at a different time within a one-year period after payment.

Seller may cancel the programme 48 hours prior to the start of the programme if the minimum number of 12 people is not met. In such a case, with the cancellation, Buyers will automatically receive a coupon code, which can be redeemed for another date for the same city tour within a one-year period after payment.

Seller guarantees to announce new tour dates within 3 months at the latest.

Conditions of participation

Everyone can participate in the programmes at their own risk. Children under the age of 14 can participate in the programmes only with parental supervision.

The minimum number of participants for the programmes is a fixed 12 people and the maximum can be variable, but it is typically 18 people.

It is strictly forbidden to participate in the programmes while under the influence of alcohol or other mind-altering substances.

Due to the characteristics of the visited sites, the programmes are not recommended for persons with reduced mobility, elderly persons, and those who suffer from any serious illness (e.g. cardiovascular diseases). In such a case, please inquire about the specific programme at one of the provided contact details.

Seller is not responsible for any injuries or accidents that may occur during the programmes.

Registration for the programmes – in whichever form – also means accepting the conditions of participation.

While participating in the programme, in order to comply with epidemiological rules:

– the use of a face mask is mandatory on the bus and indoors,

– hand disinfection with own equipment is mandatory before boarding the bus,

– participation is only possible for healthy individuals.

Right of withdrawal

Buyer has the right to withdraw from participation in the programme no later than 72 hours prior to the start of the programme, which can be done via the CANCEL tour link found in the confirmation email. In case of cancellation, we will send a coupon code, so the paid participation fee can be redeemed once for the same city tour at a different time within a one-year period after payment.

By paying the participation fee, Buyer finalises its intention to participate, therefore Seller is not obligated to repay the participation fee.

Seller may cancel the programme 48 hours prior to the start of the programme if the minimum number of 12 people is not met. In such a case, with the cancellation, Buyers will automatically receive a coupon code, which can be redeemed for another date for the same city tour within a one-year period after payment.

Data handling

Under no circumstances will Seller disclose personal data provided during registration to third parties and – without a specific permission to do so – will not use the provided data for any other purpose.

The written content and images on the website constitute Seller’s exclusive property, so any use, copying or reproduction thereof may implicate legal consequences.

Additional provisions

Seller shall not be liable for any thefts, lost or damaged property, personal injuries or accidents that eventually occur during the programmes.

Seller is not responsible for the quality of the beverages, food, foodstuff consumed at the visited sites, or for any damage caused by these; in such a case the third party providing the given food, beverage or foodstuff is liable. Furthermore, Seller is not liable for allergens or any other substances or ingredients contained by the foodstuff consumed during the programmes. Seller explicitly does not assume liability for controlling these foodstuffs, neither in terms of allergens nor from any other aspect, therefore excludes all responsibility in this respect.

During the tours – occasionally – Seller or a person on behalf of it may take photographs and videos, which Seller may use later for own purposes. By registering to the tour, the persons appearing in such recordings accept this term, furthermore Seller is not obligated to ask for their permission.

If the service cannot be carried out due to a force majeure (illness, flood, earthquake, other natural disasters, etc.), Seller is not liable in any respect, it will announce additional tour dates, for which Buyers shall register again with the coupon code received at cancellation.

In questions not regulated by the above the Hungarian Civil Code is applicable.

Types of cookies used by Service Provider:

Cookies used by third parties:

Trusted partners help Service Provider to display advertisements on the website and outside of it, and analytics service providers such as Google Analytics, Google AdSense, Google AdMob, Facebook, SalesAutoPilot may also place cookies on the User’s device. 

Google Analytics uses cookies in order to help analyse the use of the website. Google places AdSense and AdMob cookies and uses a web beacon to gather information. The information stored by the cookies (including the User’s IP address) is stored on Google Inc.’s servers in the United States. Google Inc. may share the collected information with third parties where required to do so by law, or where specific third parties process the information on behalf of Google Inc. Google Inc., in the context of Google AdSense and Google Adwords remarketing, places visitor tracking cookies on the Users’ devices, which monitor the visitors’ online behaviour, and on the basis of which Google Inc. can display advertisements for them on other websites, according to their user behaviour and interests.

Checking and controlling cookies:
